Terms of Service

1. Acceptance of Terms

By accessing or using the Auto Shop Media Shop Portal ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

The Shop Portal provides auto repair shop owners with a digital platform to view and manage their applicant hiring pipeline, track candidate progress, and access AI-powered candidate nurturing tools. The Service includes both web and mobile applications.

3. Subscription & Billing

Access to the Shop Portal requires an active subscription. Current plans include:

• Flywheel Light — roughly $375/month for ongoing applicant pipeline access
• Flywheel — usually about $750/month ongoing for full active hiring support
• Guaranteed Hiring — $6,950 for guaranteed placement campaigns

Subscriptions renew monthly unless cancelled. You may cancel at any time; access continues through the end of your billing period.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use. Each account is intended for a single shop location unless otherwise agreed.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other users' data or accounts
• Reverse engineer, decompile, or disassemble the Service
• Use applicant data obtained through the Service for purposes unrelated to hiring
• Share your account credentials with unauthorized parties

6. Applicant Data

Applicant information displayed in the portal is collected through authorized advertising and job posting channels. You agree to use applicant data solely for employment-related purposes and in compliance with all applicable employment and privacy laws.

7. Intellectual Property

The Service, including its design, features, and content, is owned by Auto Shop Media. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

8. Limitation of Liability

Auto Shop Media is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim. We do not guarantee that any applicant will be hired or that the Service will meet specific hiring outcomes.

9. Termination

We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 90 days following termination for backup purposes.

10. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.

11. Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.
